INTRODUCTION

Welcome to AdShield, Inc., a company incorporated in the Republic of Korea (“Company”; “we”; “us”; or “our”).  This Privacy Policy explains how we collect and process information through our website at https://www.ad-shield.io/ (“Website”) and our advertising technology platform (the “Platform”, and together with the Website, collectively the “Service”).  Please read this Privacy Policy carefully to understand our policies and practices regarding such information.  If you do not agree with our policies and practices, you should not use the Services. By accessing or using this Website, you agree to this Privacy Policy.

Users in certain jurisdictions, such as residents of a U.S. state with a comprehensive consumer privacy law, the United Kingdom, European Economic Area and Switzerland, have specific rights which are set forth in the YOUR RIGHTS, CHOICES AND OPT OUT section below.

INFORMATION COLLECTION

The Platform provides ad-tech solutions for the ad-blocked web. Web browser settings or downloadable software can enable consumers to block online advertising. This process is known as ad blocking. If a consumer sets their preferences to block general advertising without disabling ad serving, the Platform can be used to enable advertising.

With respect to the personal information that our clients (such as website publishers) and their vendors collect from you via the Platform (“Service Data”), where permitted by law, we process such information only as a “service provider” or “data processor” (as those terms are defined under applicable data protection laws) on behalf of our clients, who act as the “business” or “data controller” (as those terms are defined under applicable data protection laws). In such cases, our clients are the parties that control the use of the Service Data and determine the purposes for which we process such information. While this Privacy Policy describes how we process Service Data on behalf of our clients, our clients are responsible for their own practices in collecting, using, and disclosing information they collect from you. To learn more about such clients’ use of your information and your rights that you may have over such information, please consult the privacy policy of the applicable company or publisher.

Our Service collects information that identifies, relates to, describes, references, or is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer ("personal information", also called “personal data” under some laws). PAYMENT DETAILS

If you make a payment through the Website or create a profile on our publisher dashboard, your payment details (which may include account number, routing number, swift code, bank name, bank address and similar information) are provided either to us or directly to our payment processors, such as Stripe. You may read Stripe’s privacy policy at https://stripe.com/privacy to understand how they use your information. If your payment card details are sent to our payment processors, then we only receive your partial payment card details for verification.

COOKIES

Browsing information is automatically collected through various means such as cookies and pixels through our Service or in our emails.  “Cookies” are pieces of information that may be placed on your device by a service for the purpose of facilitating and enhancing your communication and interaction with that service or delivering targeted advertisements. Many services use cookies for these purposes.  We may use cookies (and similar items such as clear gifs, web beacons, pixels, tags, etc…) through our Website to customize your visit, to analyze how you use our Service, for other purposes to make your visit more convenient, to manage your account or to enable us to enhance our Service and in connection with the delivery of targeted advertisements through the Platform.

HOW WE USE YOUR INFORMATION

We use information that we collect from you:

  • To deliver our Service to you and analyze its usage;
  • To fulfill orders for our Platform placed through the Website;
  • To provide you with information, such as email newsletters;
  • To market our services to you;
  • To carry out our obligations and enforce our rights;
  • In any other way we may describe when we collect the information from you; and
  • For any other purpose with your consent.

DISCLOSURE OF YOUR INFORMATION

We may disclose your personal information as described in this Privacy Policy or otherwise with your consent:

  • To contractors, service providers, and other third parties we use to support our business and fulfill product orders.  Service providers may include Amazon, Google, Cloudflare and Salesforce.  However, such parties are only authorized by us to use the information for the benefit of us;
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Company’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Company is among the assets transferred;
  • To companies within the same corporate family as Company;
  • To comply with any court order, law, or legal process, including to respond to any lawful government or regulatory request;
  • To enforce or apply our policies or investigate fraud; and
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Company, our users, clients or others.

TARGETED ADVERTISING ON OUR WEBSITE

We may work with third parties who collect information on our Website through the use of cookies and similar methods in order to serve you with relevant advertisements on other services or to determine that you have seen our advertisements on other services.   We also collect and process information to serve you with advertisements through other platforms and services that you use.  You may opt-out of being tracked online by certain companies who are listed at http://www.aboutads.info/choices/ or http://www.networkadvertising.org/managing/opt_out.asp and may also learn more about online behavioral advertising at such websites. If you opt-out, you will still receive advertisements, but they will not be delivered to you by such companies from whom you have opted-out based upon your behavioral data possessed by the companies from whom you have opted-out. The opt-out process through the Digital Advertising Alliance and Network Advertising Initiative relies upon the placement of an opt-out cookie on your device, and you must repeat this process on each device or if your cookies are purged from your device.  Cookie-based opt-outs are not effective on certain mobile services. DATA RETENTION

We will retain your information for as long as your account is active or as needed for us to manage and provide our services and for our business needs. Even if we delete some or all of your personal information, we may continue to retain and use de-identified or aggregate data previously collected.

Information collected via the Platform is retained for 12 months, after which it is deleted.

YOUR RIGHTS, CHOICES AND OPT OUT

  • Right to delete. You may have the right to delete personal information that you have provided or that we have obtained about you. Please note that we may deny such a request if the requested deletion falls under an exception as set forth in the State Privacy Laws. Additionally, for residents of Colorado, Connecticut, and Texas, if you request deletion of your personal information and we have obtained such information from a third-party source, we may retain such data by keeping a record of the deletion request and the minimum data necessary to ensure that your personal information remains deleted from our records and that such retained data is not used for any other purpose, or we may opt you out of the processing of such personal information for any purpose except for those allowed under State Privacy Laws. Some State Privacy Laws, like those of Iowa and Utah, limit this right to only the data you have provided us.
  • Right to correct. Unless you reside in Iowa or Utah, you may have the right to correct inaccuracies in your personal information, taking into account the nature of the personal information and the purposes for which we process it.
  • Right to opt out. You have the right to opt out of the processing of your personal information for purposes of: (i) targeted advertising; (ii) the sale of personal information; (iii) profiling in furtherance of decisions that produce legal or similarly significant effects concerning you, unless you reside in Iowa or Utah or (iv) selling/sharing (as defined by the CCPA).

    We may use personal information collected on this Website for targeted advertising but  do not use personal information collected on this Website for profiling in furtherance of  decisions that produce legal or similarly significant effects concerning you or for “sales”  or “shares” (as defined under State Privacy Laws).

    Where required by State Privacy Laws, we will treat opt-out preference signals (such as the Global Privacy Control) as a request to opt-out.
  • Right to nondiscrimination. You have the right not to receive discriminatory treatment by us for the exercise of your privacy rights. Unless permitted by the State Privacy Laws, we will not:
  • Deny you goods or services;
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties;
  • Provide you a different level or quality of goods or services; or
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

EXERCISING YOUR U.S. STATE PRIVACY RIGHTS.

To exercise any of the rights described above, you may:

Only you, or a person or business entity that you authorize to act on your behalf (an “authorized agent”), may make the requests set forth above. You may also make a request on behalf of your minor child. If you are an authorized agent or an adult acting on behalf of your minor child, please reach out by emailing to legal@ad-shield.io so we could verify your authority.

In order to protect the security of your personal information, we will not honor a request if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.  However, we will process opt-out requests without any additional verification, unless we suspect fraud. The method used to verify your identity will vary depending on the nature of the request. Generally speaking, verification will be performed through technical means of matching your device or identifiers to the data we possess.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

We will make every effort to respond to your request within 45 days from when you contacted us. If you have a complex request, the State Privacy Laws may allow us up to 90 days to respond. We will still contact you within 45 days from when you contacted us to let you know we need more time to respond.

If we decline to take action on a request that you have submitted, we will inform you of our reasons for doing so, and provide instructions for how to appeal the decision. Depending on your state of residence you may have the right to appeal within a reasonable period of time after you have received our decision. If you have this appeal right, within 60 days (45 days for residents of Colorado) of our receipt of your appeal, we will inform you in writing of any action taken or not taken in response to the appeal, including a written explanation of the reasons for the decisions. If we deny your appeal, we will provide you with a method for contacting your state attorney general’s office to submit a complaint to the extent required by State Privacy Laws.

EUROPEAN PRIVACY RIGHTS

IF YOU ARE SITUATED IN THE EUROPEAN ECONOMIC AREA, SWITZERLAND, OR THE UNITED KINGDOM, THIS SECTION APPLIES TO OUR COLLECTION, USE, AND DISCLOSURE OF YOUR PERSONAL DATA AND ADDITIONAL RIGHTS YOU HAVE UNDER APPLICABLE LAW.

Legal Basis

We will only use your “personal data,” as that term is defined under the General Data Protection Regulation and comparable laws (“GDPR”), when the law allows us to. Most commonly, we will use your personal data in the following circumstances:

  • Where we need to perform the contract we are about to enter into or have entered into with you.
  • Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests.  These legitimate interests include:
    • Measuring the performance of certain online content;
    • Measuring audience insights on an aggregated, and not user-level, basis;
    • Use information to improve our existing Services and to develop new services;
    • For security purposes and to prevent fraud;
    • To enable an ad server to deliver advertising content; and
    • To save a user’s privacy choices.
  • Where you have consented to a certain use of your personal data, such as through the consent process on a website.
  • Where we need to comply with a legal or regulatory obligation.

To the extent permitted under applicable laws, we will also process, transfer, disclose, and preserve personal data when we have a good faith belief that doing so is necessary.

Transparency & Consent Framework

AdShield, Inc. complies with IAB Europe’s Transparency & Consent Framework (TCF) principles. When AdShield is accessing / collecting data via a publisher’s website as part of the Platform, AdShield relies upon that publisher to make the appropriate privacy disclosures to you, including integrating with the TCF.

Supervisory Authorities

If you are situated in the EEA, Switzerland, or the UK and have any complaints regarding our privacy practices, you have the right to make a complaint at any time to your local supervisory authority. We would, however, appreciate the chance to deal with your concerns before you approach your supervisory authority, so please contact us in the first instance. Provision of personal data and failure to provide personal data

Where we need to collect personal data by law or under the terms of a contract we have with you, and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with our services). In this case, we may not be able to provide certain services to you.

Collection of personal data from third-party sources

We may obtain personal data and other information about you from public sources and through our third-party partners who help us provide our products and services to you.

Withdrawing your consent

If we are relying on your consent to process your personal data, you have the right to withdraw your consent at any time by contacting us at legal@ad-shield.io.

Data Transfer

We may transfer personal data from the EEA, Switzerland, and the UK to the United States and other countries, some of which have not been determined by the European Commission or the UK Secretary of State to have an adequate level of data protection. Where we use certain vendors, we may use specific contracts approved by the European Commission or the UK Secretary of State which give personal data the same protection it has in Europe.

Data Subject Rights

If you are situated in the European Union, Switzerland, or the UK, under the GDPR, as a data subject, you have the right to:

  • Request access to your personal data (commonly known as a "data subject access request"). This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.
  • Request correction of the personal data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.
  • Request erasure of your personal data. This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. We will advise you if this is the case at the time you withdraw your consent.

This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. In order to verify your identity, we may need to gather more personal data from you than we currently have.

Safeguarding your personal information is a top priority. We have implemented reasonable security measures designed to protect your data from unauthorized access, misuse, alteration, or disclosure. While we take extensive precautions to ensure the security of your information, it is important to note that no method of data transmission over the Internet or electronic storage is 100% secure. CHANGES TO OUR PRIVACY POLICY

We may change this Privacy Policy at our discretion at any time. If we do make any changes, such change will appear on this page of our Website. The date the Privacy Policy was last revised is identified at the top of the page. Your continued use of the Website following any changes means that you have accepted, consent to, and agree to be bound by such revised Privacy Policy.

CHILDREN UNDER THE AGE OF 18

Our Website is not intended for children under 18 years of age. We do not knowingly collect personal information from children under 18. If we learn we have collected or received personal information from a child under 18 without verification of parental consent, we will delete that information. UNITED STATES OF AMERICA / CROSS BORDER DATA TRANSFERS:

Our Company has personnel in various countries. By using the Service, you authorize the export of personal information from your home jurisdiction to other countries and its storage and use as specified in this Privacy Policy, such as the United States of America. Information stored in the USA may be subject to lawful requests by the courts or law enforcement authorities in such countries.
